Notice to Depositors of Bradford Bank
On August 28, 2009, the Office of Thrift Supervision closed Bradford Bank, and appointed the Federal Deposit Insurance Corporation (FDIC) as receiver. The FDIC, which insures your deposits, arranged for the transfer of your deposit(s) to Manufacturers and Traders Trust Company (M&T Bank). This arrangement should minimize any inconvenience the closing of Bradford Bank may cause you. Please rest assured that you do not need to withdraw your funds or move your funds to a new institution; however, you must take some action to claim ownership of your deposit(s) as described below.
Under federal law 12 U.S.C. Section 1822(e) you must claim ownership of your deposit(s) at the new institution (M&T Bank) within 18 months from the closing date. If you do not claim your deposit(s) by February 28, 2011, M&T Bank must return your deposit(s) to the FDIC.
How to Claim Ownership of Your Deposits
You may claim your deposit(s) by taking any of the following actions by
February 28, 2011:
- Making a deposit to or withdrawal from your account(s). This includes writing a check on any account or having an automated direct deposit credited to or an automated withdrawal debited from your account(s).
- Executing a signature card on your account(s), entering into a new deposit agreement with M&T Bank, changing ownership on your account(s), or renegotiating the terms of a certificate of deposit account.
- Providing M&T Bank with a completed change of address form.
- Writing M&T bank and notifying us that you wish to keep your account(s) active. Please be sure to include in the notice the name(s) on the account(s), the account numbers, and the signature of an authorized signer on the account(s), with name and address.
Claim your deposits using this fillable PDF form. Please print a copy of this form for your records. Send the completed form by mail to:
PO Box 767
Attn: Account Services
Buffalo, NY 14240-0767
Or, return the completed (signed) form to your local M&T Bank branch.
Please note that if you have more than one former Bradford deposit account, your action to claim your deposits from one account will automatically claim your deposits in all of your former Bradford accounts. We appreciate your cooperation with us in implementing this rule because we can only apply this rule where we can identify the relationship between the accounts. So, for example, accounts held in the same legal capacity using the same taxpayer identification number will be readily identifiable by M&T Bank. But accounts held in different legal capacities that use different tax identification numbers may not be claimed and we would appreciate your cooperation in helping us identify them. (For example, if you hold an account in your individual name using your social security number and you are the authorized signor on your business account that uses a different, unique tax identification number, the claim of your individual account will not automatically claim the business account. You will need to make a separate claim for the business account.)
In the coming weeks, you will receive additional information regarding your new M&T Bank accounts and the terms associated with them. If you have any questions regarding the transition of your accounts to M&T Bank, please call the M&T Telephone Banking Center at 1-866-491-2642.
