CARES Act IRA Impacts

The Coronavirus Aid, Relief, and Economic Security (CARES) Act is now in effect to help those financially impacted by COVID-19 (coronavirus).

Specific to Traditional IRA and retirement accounts only (does not apply to Roth IRAs), the CARES Act allows access to your IRA funds, as well as waives the 2020 Required Minimum Distributions (RMDs).

This overview focuses on federal tax treatment under the CARES Act, and does not consider state or local taxes. Please consult your tax advisor regarding the complexity of the CARES Act, state and local taxes, and how they may impact your individual situation.

Coronavirus-Related Distributions

The CARES Act allows you to:

  • Withdraw up to $100,000 from your IRA and not incur the 10% early withdrawal penalty
  • Spread the taxes you incur as a result of the withdrawal over three (3) years
  • Re-contribute the funds withdrawn back to your IRA over three (3) years - if you choose to do so, no taxes will be due on the amount repaid. Please note: Repayments must be made to a qualified plan or an IRA that can accept rollovers - the re-contribution option does not apply to inherited IRAs

To qualify during 2020, you should meet one of the following:

  • Been diagnosed with COVID-19 by a CDC-approved test
  • Have a spouse or dependent who is diagnosed with COVID-19
  • Experienced financial hardship as a result of being quarantined, furloughed or laid off or having work hours reduced, or being unable to work due to lack of child care

Waivers of 2020 Required Minimum Distributions (RMDs)

Who is eligible:

  • Traditional, SEP and Inherited IRA owners who would normally have an RMD due by December 31, 2020 and/or who turned 70½ in 2019 and elected to defer their first RMD until April 1, 2020
  • Inherited IRA beneficiaries will not be required to count 2020 as part of the five-year period to complete distribution of an inherited IRA, essentially giving them six years to complete distribution of the IRA

Can an IRA owner return a previously distributed RMD?

  • Currently, an RMD taken in January 2020 cannot be returned through a rollover. Under recent IRS relief, an individual who took an RMD between February 1, 2020 and May 16, 2020 has until July 15 to repay (e.g., rollover) the RMD, provided the individual did not complete an IRA to IRA rollover within the previous 12 months
  • Qualified individuals who took an RMD in January 2020 and cannot rely on the 60-day rollover relief should consult their tax advisors about recharacterizing the RMD as a Coronavirus-Related Distribution
  • IRA distributions made on or after May 17, 2020 that would normally be considered an RMD may be rolled over into an eligible retirement plan or IRA, provided the distribution would otherwise be an "eligible rollover distribution". In that case, the following regular rollover rules still apply: a) the distributed proceeds must be rolled over to an eligible retirement plan or IRA within 60 days of receipt of the distribution; and b) for an IRA to IRA rollover, the individual cannot have completed an IRA to IRA rollover within the previous 12 months
  • The ordinary rollover rules do not allow life expectancy payments to be returned to Inherited IRAs
